Smith Moore Wins Arbitration With Krispy Kreme

An arbitration panel awarded Smith Moore LLP clients $7,925,000 for breach of contract in a ruling against Krispy Kreme Doughnuts Inc. (NYSE: KKD) of Winston-Salem, N.C., and its franchisee in Northern California, Golden Gate Doughnuts Company LLC. The arbitration took place over a six-day period in Winston-Salem. The interim ruling was announced late Friday and was made public by a Krispy Kreme press release Monday. Martin Erwin and Manning Connors of Smith Moore’s Greensboro office represented the petitioners.

The case originated from a lawsuit filed in March 2000 in the California Superior Court regarding ownership rights of the franchise. A final decision and written opinion on the case is expected in the coming months after the arbitration panel considers additional costs and attorney fees.
