This recognition comes close on the heels of another honor for Smith Moore's attorneys. In December 2002, the firm announced that 17 lawyers from its North Carolina offices had been selected for inclusion in The Best Lawyers in America® 2003-2004, the preeminent legal referral guide in the United States. Demonstrating the firm's strong commitment to quality legal counsel, seven attorneys were selected for inclusion in both The Best Lawyers in America® and the Legal Elite. These attorneys are E. Kent Auberry, J. Donald Cowan Jr., Alan W. Duncan, Stephen W. Earp, Charles E. Melvin, Larry B. Sitton and Julianna C. Theall.

In determining the attorneys qualified to make the list of the second annual Legal Elite, Business North Carolina distributed ballots to more than 7,000 lawyers across North Carolina and asked them to vote for the attorneys they thought were the best in each of the 10 business-related categories. Participants were not permitted to vote for themselves. Attorneys could vote for members of their firms, but only if they also voted for someone outside of their firm in the same category. Votes cast for attorneys outside of a voter's firm were weighed more heavily than those for colleagues. Lawyers who did not receive votes from outside of their firm did not qualify, regardless of the number of votes received.
