Jay Holland is a partner in our Wilmington office.  Jay began his legal career in our Raleigh office in 2002 and moved to our Wilmington office in 2008 to service the litigation needs of the firm's clients in eastern North Carolina.  Jay represents insurance, health care, banking and other business entities, as well as closely-held companies and individuals, in state and federal trial and appellate courts.

Jay and his wife, Brandi, have three sons.  They are members of Wesleyan Chapel United Methodist Church in Wilmington, NC.  Jay is active in civic and community affairs, including coaching youth baseball.

Representative Work

Business Litigation
Jay has litigated matters involving disputes over contracts and negotiable instruments, the collection of debts, the recovery of collateral under security agreements, and non-compete and non-disclosure agreements.  Jay has handled a variety of real estate matters, including title insurance claims, boundary disputes and partition actions, reformations of title instruments, disputes as to priority of security instruments, contested foreclosures, evictions and ejectments, landlord-tenant actions, disputes over covenants and easements, and other land use and zoning matters.

Professional Services Litigation
Jay has represented hospitals, pharmacies, skilled nursing facilities, home health agencies, physicians, pharmacists, nurses and other health care providers in medical malpractice actions, claim investigations and other disputes.  Jay also has defended attorneys in legal malpractice actions and other proceedings.

Health Care Litigation
In addition to defending health care providers in malpractice cases, Jay has represented health care providers in disputes involving Medicare and Medicaid payment issues, medical liens, health plans, managed care service contracts, and guardianship proceedings.

Prior to joining the firm, Jay worked seven years as an insurance claims consultant. He managed hundreds of property and casualty claims, including automobile liability, business interruption, commercial general liability, fidelity, medical professional, premises liability and product liability claims.  Since joining the firm, Jay has represented insurance companies and their insureds in the defense of automobile liability, general liability, legal malpractice, premises liability, and medical malpractice claims.  He also has advised clients on insurance coverage disputes, risk management matters, and insurance regulations.

Jay is a member of the firm's Transportation Industry Group, which represents trucking companies, brokers and logistics companies (and their insurers) with disputes involving commercial transportation accidents, federal and state safety regulations, insurance coverage disputes, and freight claims.  Jay serves on the firm's Emergency Response Team, which responds to the urgent needs of our clients following a catastrophic accident.

Cybersecurity and Data Breach
Jay is a member of the firm's Cybersecurity and Data Breach Group, which assists clients with the management and protection of sensitive business and personal information.
